Liability Waiver

Rodriguez Production Studio Rental Release of Liability Agreement

This Release of Liability Agreement ("Agreement") is entered into by and between Rodriguez Production ("Studio"), located at 815 Lincoln Way West, South Bend, IN 46616, and the undersigned renter ("Renter"), for the rental of studio space. This Agreement shall remain in effect for all future rentals by the Renter, unless revoked in writing by either party.

1. Assumption of Risk & Release of LiabilityRenter understands and acknowledges that the use of the studio space may involve risks, including but not limited to personal injury, property damage, or loss. By signing this Agreement, Renter assumes full responsibility for any risks, injuries, or damages that may occur to themselves, their attendees, or any third parties during the rental period.Renter hereby releases, waives, and forever discharges Rodriguez Production, its owners, employees, agents, and affiliates from any and all liability, claims, demands, actions, or causes of action arising out of or related to any loss, damage, injury, or harm, including but not limited to bodily injury or property damage, that may be sustained while using the studio space. Renter agrees to this contract for themselves and for their friends and family.

2. Responsibility for Damages & Stolen ItemsRenter is solely responsible for any damages to the studio, its equipment, furniture, or any other property caused during the rental period. Renter agrees to reimburse Rodriguez Production for any necessary repairs or replacements. Additionally, Renter is responsible for any lost, stolen, or missing items that occur during their rental period.

3. Indemnification & DefenseRenter agrees to indemnify and defend Rodriguez Production against all claims, causes of action, damages, judgments, costs, or expenses, including attorney fees or other litigation costs, which may in any way arise from Renter, their family’s, or their attendees' use of or presence upon the facilities of Rodriguez Production.

4. Compliance with Studio Rules & DirectionsRenter agrees to follow all studio rules, policies, and directions provided by Rodriguez Production staff. Failure to adhere to studio guidelines may result in termination of the rental period without refund and potential forfeiture of the security deposit.

5. Cleaning & Timely DepartureRenter is responsible for leaving the studio in the same condition as it was upon arrival. The space must be cleaned, and all personal items and trash removed by the end of the rental period. If the studio is not cleaned or if Renter does not vacate the premises by the agreed-upon time, Renter forfeits their security deposit.

6. FeesRenter agrees to pay for all damages to the facility of Rodriguez Production caused by any negligent, reckless, or willful actions by Renter, their family, or their friends.

7. Arms-Length AgreementThis Agreement and each of its terms are the product of an arms-length negotiation between the parties. In the event ambiguity is found to exist in the interpretation of the Agreement or any of its provisions, the parties explicitly reject the application of any legal or equitable rule of interpretation that would lead to a construction either for or against a particular party based upon their status as the drafter.

8. EnforceabilityThe invalidity or unenforceability of any provision of this Agreement shall not affect the validity or enforceability of any other provision. Any invalid or unenforceable provision shall be deemed not to be a part of this Agreement.

9. AcknowledgmentRenter has read this document and understands it. Renter further acknowledges that by signing this release, they voluntarily surrender certain legal rights. This Agreement shall remain in effect for all future rentals by the Renter, unless revoked in writing by either party.

1. General Use

R Studio is a creative studio and event space operated by Rodriguez Production. By booking or using our services or studio space, you ("Client" or "Renter") agree to the terms outlined below.

2. Studio Rental Terms

  • Rental Rates:

    • $50/hour (Monday–Thursday)

    • $65/hour (Friday & Sunday)

    • $75/hour (Saturday)

  • Add-ons:

    • $65 for up to 40 chairs and 5 tables

    • $140/hour for on-site event photography

  • Security Deposit:A $100 refundable deposit is required for all studio rentals. This may be withheld if the space is left dirty, damaged, or not vacated on time.

  • Card on File:A valid credit/debit card is required to be kept on file. R Studio reserves the right to charge up to $100 post-rental for cleaning or damage-related expenses.

  • Booking Requirements:Clients must agree to and digitally sign the Rental Agreement and Release of Liability prior to confirmation. Full payment is required to secure a booking.

3. Cancellations & Rescheduling

  • Cancellations must be made at least 72 hours in advance to receive a full refund.

  • Cancellations within 72 hours will result in a 50% refund.

  • Cancellations within 24 hours are non-refundable.

  • Rescheduling is permitted once per booking with 48-hour notice.

4. Use of Studio

  • Renter is responsible for clean-up, trash removal, and returning the space to its original condition.

  • Renter must vacate the studio by the end of the agreed rental period. Overtime fees may apply at 1.5x the hourly rate.

  • No smoking or illegal substances are permitted.

  • No animals allowed unless agreed upon in writing.

  • NO TAPE OF ANY KIND ON FLOORS

5. Photography & Videography Services

  • All services are priced based on time, deliverables, and staffing needs. A 3% service and processing fee applies to all bookings.

  • Turnaround times for edited content will be communicated during booking. Rush edits may be available for an additional fee.

  • Rodriguez Production retains the right to use media for promotional purposes unless the client requests otherwise in writing.

6. Liability & Indemnity

Clients use the studio and services at their own risk. Rodriguez Production and R Studio are not responsible for:

  • Lost, stolen, or damaged personal items

  • Injuries occurring during use of the studio

  • Weather-related cancellations (we will offer rescheduling in such cases)

Clients agree to indemnify and hold harmless Rodriguez Production, its owners, and employees from any liability, claims, or expenses related to their booking or presence on-site.

7. Conduct & Damages

We reserve the right to refuse service or terminate bookings if clients or their guests act inappropriately, violate rules, or endanger others or the property. All damages will be assessed and invoiced after the booking.

8. Changes to Terms

Rodriguez Production reserves the right to update these Terms and Conditions at any time. The most recent version will always be available on our website or by request.

By booking with Rodriguez Production or R Studio, you acknowledge that you have read, understood, and agree to these Terms and Conditions.
